StreamIt.Church Terms of Service

2.1 Faith-Based Mission Requirement

StreamIt.Church is a faith-based platform dedicated to serving churches and religious organizations. We reserve the right to approve or deny any application based on alignment with our platform's faith-based mission and community standards.

2.2 Application Process

To use the Platform, your Church must complete our application process. During this process, you will provide information about your organization, its leadership, and how you intend to use the Platform.

2.3 Approval Authority

Our designated Super Admin (Company administrator) has the sole discretion to approve, deny, or request additional information for any application. We may deny applications from organizations that do not align with our faith-based values or that we determine present unacceptable compliance risks.

2.4 Timeline

We aim to review applications within 5 business days of submission. Approval does not guarantee continued access if circumstances change or if we discover material misrepresentations in your application.

3.1 Available Plans:

• Starter: $49/month
• Growth: $109/month
• Pro: $249/month
• Premium: $999/month

3.2 No Trial Period

Upon approval, your Church will be charged the full subscription fee for your selected plan. We do not offer trial periods or partial-month pricing adjustments.

3.3 Billing

Charges are processed immediately upon approval. Payment is collected on the same day each month (your subscription anniversary date). All prices are in USD unless otherwise agreed in writing.

3.4 Payment Method

Payment is processed through Stripe. You authorize us to charge your provided payment method. We do not store credit card information; all payment data is handled securely by Stripe in compliance with PCI standards.

4.1 No Refunds for Partial Months

All subscription fees are final and non-refundable. We do not provide refunds, credits, or prorated refunds for partial months of service. If you cancel mid-month, you remain responsible for the full monthly charge for that billing period.

4.2 Recurring Charges

By entering into these Terms, you authorize recurring monthly charges to your payment method.

4.3 Price Changes

We reserve the right to modify pricing with 30 days' written notice. Price increases will take effect on your next renewal date.

5.1 Cancellation by Church

You may cancel your subscription at any time by providing written notice to our support team. Cancellations must be submitted at least 5 business days before your next billing date.

5.2 Termination of Access

Upon cancellation, your access to the Platform will be revoked at the end of your billing period.

5.3 Data After Cancellation

Upon cancellation, we will retain your data for 30 days, after which it will be permanently deleted. You are responsible for downloading or backing up any content you wish to preserve.

5.4 Termination by Company

We may terminate or suspend your access immediately if: (a) you violate these Terms; (b) you fail to pay subscription fees; (c) your Church is no longer faith-based or violates our community standards; (d) your Church violates applicable law.

5.5 No Liability for Termination

We shall not be liable to you for any suspension or termination of your access.

6.1 Church Content

You retain all ownership rights to content you upload. By uploading, you grant StreamIt.Church a non-exclusive, royalty-free license to host, transmit, and display your content for operating the Platform.

6.2 Faith-Based Content Requirement

All Church Content must be consistent with your Church's faith tradition. Content that is profane, sexually explicit, violent, hateful, or otherwise inappropriate is strictly prohibited.

6.3 Prohibited Content

You agree not to upload content that: (a) violates intellectual property rights; (b) contains malware; (c) is defamatory or fraudulent; (d) violates privacy rights; (e) is illegal; or (f) promotes discrimination, hatred, or violence.

6.4 Right to Monitor

We reserve the right to monitor, review, and remove any Church Content that violates these Terms.

7.1 Member Data Collection

Your Church may collect member data through the Platform. You are responsible for collecting, managing, and securing this data in compliance with applicable privacy laws.

7.2 Processor Role

StreamIt.Church acts as a data processor on behalf of your Church. We process member data only as directed by your Church.

7.3 Data Security

We employ industry-standard security measures to protect member data.

8.1 "As Is" Service

The Platform is provided on an "AS IS" and "AS AVAILABLE" basis. We disclaim all warranties, express or implied.

8.2 Service Interruptions

We do not guarantee 100% uptime. We are not liable for any downtime or service interruptions.

8.3 Third-Party Services

The Platform relies on AWS, Stripe, and Resend. We are not responsible for interruptions caused by these providers.

9.1 Cap on Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RAINWOOD VISUALS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

9.2 Direct Damages Limitation

OUR TOTAL LIABILITY SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

9.3 Exceptions

These limitations do not apply to: (a) death or personal injury; (b) gross negligence; or (c) fraud.

10.1 Company IP

StreamIt.Church, the Platform, our technology and logos are owned exclusively by Rainwood Visuals LLC. You are granted a limited, non-exclusive license to use the Platform solely for your Church's internal purposes.

10.2 Restrictions

You may not: (a) reverse engineer; (b) copy or create derivative works; (c) resell access; (d) remove proprietary notices; or (e) use the Platform for competitive purposes.

11.1 DMCA Compliance

StreamIt.Church complies with the Digital Millennium Copyright Act (DMCA).

11.2 Copyright Infringement Claims

Submit written notice to legal@streamit.church with: (a) identification of the copyrighted work; (b) identification of the infringing content; (c) your contact information; (d) statement under penalty of perjury; and (e) your signature.

11.3 Counter-Notice

If your content is removed due to a DMCA claim, you may submit a counter-notice if you believe the removal was erroneous.

13.1 Governing Law

These Terms are governed by the laws of the State of Texas.

13.2 Exclusive Jurisdiction

Any dispute shall be resolved in the state or federal courts located in Texas.

13.3 Arbitration Waiver

Except as required by law, you waive your right to arbitration and class action participation.
